§ 34. Variances, special exceptions and appeals.

  • The board of aldermen may hear and decide where it is alleged that there are practical difficulties or unnecessary hardships in the way of carrying out the strict letter of the regulations, to vary or modify the application of any of the regulations or provisions of the regulations relating to the construction, or alteration of buildings or structures so that the spirit of the law shall be observed, public safety and welfare secured, and substantial justice done. In exercising all of its aforementioned and following described powers the board may, in conformity with Louisiana Revised Statute[s] 33:4721 through [33:]4729 [R.S. 33:4721—R.S. 33:4729] and the provisions of this article, reverse or affirm, wholly or partly, or may modify the order, requirement, decision or determination appealed from and may make such order, requirement, decision or determination as ought to be made, and to that end shall have all of the powers of the officer from whom the appeal is taken.
